Yes. Foreign nationals can acquire rights to property in Baja California, but residential property within Mexico's restricted zone is commonly held through a Mexican bank trust called a fideicomiso. The appropriate structure depends on the property, its intended use and the buyer's circumstances.
What is a fideicomiso?+
A fideicomiso is a bank trust through which a Mexican bank holds legal title to restricted-zone property while the foreign buyer is named as beneficiary. The beneficiary can generally use, improve, sell, lease and transfer beneficiary rights subject to the trust agreement and Mexican law.
Do I still need an attorney if a notary is handling the closing?+
A Mexican Notario Público performs important legal and governmental functions in a property transfer, but the notary does not necessarily act as the buyer's personal legal advocate. An independent attorney can review the transaction and advise the client about individual risks, rights and obligations.
Should an attorney review the contract before I pay a deposit?+
Whenever possible, legal review should occur before signing a reservation, purchase or deposit agreement and before transferring significant funds. Early review provides a better opportunity to clarify conditions, deadlines, refund provisions and remedies.
